Earthquakes' Wondolowski chosen MVP of MLS

NEW YORK (AP) - San Jose Earthquakes striker Chris Wondolowski has won the MVP award in Major League Soccer.

The league's leading scorer with 27 goals tied the single-season record. He won 91 percent of MLS club management votes, 97 percent of media votes and 71 percent of player votes.

Thierry Henry of New York Red Bulls was runner-up and Graham Zusi of Sporting Kansas City was third.

Mo., Ariz. reveal where Powerball winners were sold

In an odd coincidence, several of the winning Powerball numbers matched the jersey numbers of baseball players in the Kansas City Royals Hall of Fame: Mark Gubicza, Dan Quisenberry and Dennis Leonard to name a few. NBC's Kerry Sanders reports.

Updated at 7:50 p.m. ET:?The search for the two big winners of Wednesday night?s Powerball drawing is narrowing.

Missouri lottery officials announced Thursday that one of the Powerball tickets worth $293.7 million was sold at a Trex Mart in Dearborn, Mo. And Arizona officials said the other winning ticket in the $587.5 million jackpot was sold at the 4 Sons Food Store in Fountain Hills, Ariz.

Missouri lottery officials said they will announce the state's winner at a press conference Friday. Officials have not yet identified the Arizona winner.

The Arizona store that sold the ticket will receive a $25,000 bonus incentive, while the Missouri store will get $50,000.

Lottery officials have not said whether the winning numbers of Wednesday night's record drawing --?05 - 16 - 22 - 23 - 29 and Powerball 06 -- were picked by individuals or groups.

"It is so exciting to sell one of these Powerball tickets," Missouri Lottery executive director?May Scheve Reardon said in a press release Thursday. ?"In addition, we sold two tickets that matched all five white balls, which means they each win $1 million. Three millionaires in one night is a wonderful night!"

Reardon advised all winners to be sure to sign the back of their tickets and seek legal and financial advice. Missouri winners have 180 days to claim their prize.

NBC's Kerry Sanders has more on the record jackpot and looks at how the winner may have chosen their numbers.

In addition to the jackpot winners, Powerball officials said eight people won $2 million prizes and 58 other ticket holders won $1 million.

The jackpot had rolled over 16 consecutive times without a winner since Oct. 6, prompting?Americans to go on a ticket-buying spree in the run-up to the drawing. At one point, tickets were selling at a rate of 130,000 a minute nationwide ? about six times the volume from a week ago.

The Missouri and Arizona jackpot winners will share an estimated $385 million before taxes if they take the prize as a lump sum, or the $587.5 million can be paid out as annuities over three decades, the Multi-State Lottery Association told Reuters.

As lottery official Sue Dooley notes, tickets matching all five of the white balls in the record $580 million Powerball drawing, can be cashed in for $1 million in prize money.

Although this Powerball jackpot was a big one, it's not the largest lottery prize ever. That mark is held by the $656 million Mega Millions jackpot that was split by three ticket buyers earlier this year. The previous biggest Powerball prize was $365 million in 2006, shared by several ConAgra Foods workers in Lincoln, Neb.

Powerball is played across 42 states, plus Washington, D.C., and the Virgin Islands.?All but five states -- Delaware, Kansas, Maryland, North Dakota and Ohio -- require the lottery to release the winning names to anyone who asks, according to the Powerball site.

The next Powerball drawing has been reset back to $40 million.

Drunk Pics, Hot Sisters, and Long-Distance Dumping | The Hairpin

1. Here's my situation. I'm a successful, attractive 30-year-old woman who has recently (like just signed papers recently) gotten out of a painful albeit short marriage (together three years, married for one and a half). My marriage was neglectful for some time, and it took therapy and a lot of work to realize the problem wasn't me, and I feel like I have been handling things pretty well.

I had been lonely and emotionally unfulfilled in my marriage for a while. I rushed the engagement probably to hold on to someone who wasn't that into me. I feel like I have been grieving for a long time. I left because I wanted the RIGHT relationship, because mine was so screwed up and one-sided. And now I realize that marriage isn't the end-all I fantasized about, but I do want a partner and eventually a family.?

When I finally moved out, I started a profile on a dating site because I was utterly depressed and wanted to look at pictures of cute boys to help me get over my loss. Since it was my first foray into those sites, I didn't realize I would be bombarded with people who were basically just DTF... but there was one guy that struck up a convo about non-dating, non-relationshippy things and we had a nice back and forth message chain for a while. Then we started texting, and then finally, he asked me to hang out with a group of friends.?

I managed expectations and was afraid the verbal chemistry wouldn't be there, or that he would be less cute in real life. Neither of these things were the case and we ended up hanging out later that night and just BOOM SLEPT TOGETHER. Spent the next day together too. We get along well, have a lot of things in common, and crack each other up.

In the meantime, I am getting side-eye from friends and my mother about me even talking to dudes, and lots of WAIT FOREVER BEFORE YOU DO ANYTHING, so I cannot imagine how things would play out if they knew I was dating someone. Operative word DATING. I have no desire to move in together or otherwise link up in a major life commitment way right now, but I want to spend time with this person.

We have had the 'taking it slow' talk, but the truth is, I don't really know what that means. I mean, I don't want to hang out every day because I want to attend to myself and enjoy life as a single-ish lady but I also would really love some companionship and affection from a man, especially one I like. I understand the people around me are not just being busybodies, but rather probably just protective of me after all that has transpired ... and don't want me with The Wrong Dude.?

Anyway, I need to find the balance. He's patient, which is great, and has a life of his own, but we're in the talking-all-the-time mode and I don't want to just stop! Plus we hit it off in bed, so halting all further carnal activities is not something I want. How can I be careful with my heart/boundaries while still enjoying the company of someone I like? HALP.

A very similar situation just happened with a close friend of mine who is a dude. In fact it's so similar I hope you're not his ex wife who I'm obliged to detest. You're probably not! So I'll tell you what I told him.

You can't fight a vibe. I mean, you can, I suppose, but taking things slowly when the vibe is right is like trying to speed things up when you don't hit it off. It's unrealistic and not possible unless one or both of you are unbalanced weirdos. On the other hand, we can experience VERY INTENSE vibes when they are NOT HEALTHY at all. Hitting it off with someone can have as much to do with the relief they give from old, bad feelings as it can with him being the right dude. Your friends and family seem to think you are not ready to tell the difference.?

Which is what I asked my friend a few weeks ago. If, when you sit quietly with yourself and close your eyes and think about this new guy, what really comes up? If your heart feels truly free and at ease about this new relationship, then go for it. Really. I am only saying this because you said you went through a lot of therapy and worked on yourself, so I'm taking your word for it on that. Only you know if you are really ready. Just don't take for granted that you are simply because you want to be. Really listen to your gut.

It's important that you listen closely, because like I said before, you can't control the pace or depth of this new entanglement. So rather than worry about that, just be sure you're ready to ride this thing out no matter where it goes.

2. I organized a camping trip for my birthday. My friends drove long distances, the lovely (older) man who I'm dating came out ? and dropped some CASH on snacks and booze ? and we had delicious dinner and swam and everyone was having a grand time. There was music. There was a birthday cake. Really lovely, magical times. Until I got drunk. And then I was falling over. And then I was the butt of all of the jokes, rightfully, and then I went to bed. And in the morning, I was not hungover, but I did feel that kind of shame-clench that was exacerbated when the lovely older man pulled out his phone and showed a picture to everyone of me on the ground being drunk. And all of my friends laughed and laughed, and I was kind of like "ha-ha" ... poker face.

I am emerging from several years of bad-drunk tendencies. I have a therapist, we talk about depression and anxiety and booze and sex. I haven't been drinking so much for a few months, and then, this weekend, something kind of flipped and I boarded the bus to Dark, Baby Land without even knowing that that was what I was doing. But I can process this stuff with my therapist. The part that's really fucking me up is the dude. We haven't talked much about our previous lives and loves. I've not wanted to because I think it's more ... fair? ... to take someone on their current terms, but now I find myself in this gross spot where I backslid, and I don't know how much I need or want to explain.

He was affectionate on the way home. We talked on the phone after I dropped him off. We have plans this week. I apologized to him via e-mail for being such a weirdo on the night when he met all of my friends for the first time, and thanked him for being so generous. But, I don't know what to do next, with him or with myself. I showed him my worst when he was really showing me his best. And yet ...

What's up with showing off that picture? What's up with taking it? He's 20 years my senior, and I'm in my 30s, and that was totally rude, right? Or, am I so affronted because I'm sensitive about drinking and outside commentary on the way I drank because DUDE, I'M WORKING ON IT!!!? I can't tell how much import to put on all of this. I can't tell how ashamed of myself to be. I can't tell how much of an asshole he was being.

This is what we call a red flag. And it's the exact kind of red flag that most of us ignore in order to keep dating the "lovely" person we are dating.

Not all red flags are the same, in that some are across-the-board red flags and some are personally subjective red flags. Across-the-board red flags are things like violence, straight up verbal abuse, and thinking Malcolm Gladwell is a genius. You know, obvious monster shit.

Your red flag is personal to you. It is one simply because you feel it is one. What your guy did, in my opinion, is possibly quite funny and fine. But he didn't do it to me with my friends. He did it to you with yours, and it really bothers you. So it IS fucked up. To you. You need to say that to him. If he says, "Oh my God I'm so sorry I had no idea drinking and falling down wasn't hilarious to you, I feel terrible, let's discuss your past a little so we can get to know each other better bit by bit until we are in love" then maybe the flag is an opportunity to repair and become closer through mutual understanding.

But if he's like, "Whoa! C'mon, that's what phones are for, drunky!" Then he's not necessarily wrong, but probably wrong for you.

Also, he's 50 something and still taking drunk pics and laughing about them? Either he's super cool and comfortable with himself, or he's completely terrible. Either way, good luck!

3. Help! This just happened. Is it ever appropriate for a guy to mention that he finds his girlfriend's sister attractive when in conversation with both ladies? (Some logistics: I'm 24, my boyfriend is 24, my little sis is 20.)?My initial instinct was that some unwritten rule of dating had been violated, but maybe I'm being a little irrationally insecure ? she's definitely "the cute one" of the siblings, and knows how to work it, so I'm increasingly threatened by her in romantic territory. (I guess that makes me "the neurotic one.") The bf is somewhat aware of this sensitivity.?

My thoughts: Clearly he's into me, because he's dating me, and of course he's going to discreetly check out my sister because that's what guys do, but I never want to hear about how he's kinda into her as well, even jokingly over drinks. ... Too much?

PS: Haven't confronted BF about this yet, because I can't decided if this response is on-target or wildly out of line with your typical sane and self-assured lady.

Of course it's inappropriate for your boyfriend to comment on your sister. Also, of course he did it in the first place because he's 24. Aaand of course you should say something to him. Most 24-year-old guys have a lot of growing up to do before they can sustain a healthy relationship. You telling him how insensitive it was to do that is pretty much the only way he's going to learn it. I do not envy the heavy lifting required in dating dudes in their 20s, because there are so many battles to fight if you want them to become men. You should do the grooming in good faith that if you stay together, he may one day be a charming and thoughtful, mature partner for you. And if you break up down the line, you've still contributed to improving the dude pool for other ladies. Hopefully, there's a guy out there getting reprimanded for staring at the wrong butt right now, and when you meet him in five years, you won't have to tell him to keep his eyes off your sister.

?4. So, I'm in a three-year-long relationship, and, unfortunately, the time has come to end it. We've been long-distance for a while and will be long-distance for a while more, and I just can?t do it anymore. I?m exhausted. I haven't gotten enough from him emotionally/commitment-wise to make it feel worth it, and I feel taken for granted. Nothing is seriously wrong, but nothing is seriously right, and I just can't hack it anymore. I'm very broken up about it, but I guess that's just the way the cookie crumbles, right?

Anyway, my problem is this: When do I break up with him? He's coming to visit soon, and we haven't seen each other in quite some time; we've been very excited about the visit, and now I feel like a total ass. Do I break up with him before the visit and feel terrible he spent $500 for nothing? Do I wait and hope that everything resolves itself during the visit? And if it doesn?t, do I just pretend everything's okay and then at the airport be like "ummmm so I think we should see other people, this week has been great, k bye?" Ask a Dude, it really hurts me to have to end this relationship; my guy hasn't been the perfect boyfriend, but he's been pretty darn good, and I want this to be as painless for all parties involved as possible. I love him very much and I know he loves me, and this whole thing is just one sucky mess of irreconcilable differences. Blergh. Help!

End it now. I was in a similar thing many years ago, and I let the lady travel across the country for an already scheduled visit because I thought she should hear it in person. She ended up leaving four hours after getting there ? leaving on a train to the airport in the pouring rain and crying so hard I thought she was going to barf. I remember how sad she was about the break up in general, but I REALLY remember how mad she was that I let her travel all that way just to break her heart in person.

Breaking up with this guy over the phone does not make you a bad person, and doing it in person does not make it not a break up. Save him the time, the travel, and maybe some of the money.

2004 Yamaha Road Star 1700 from Canada

I just purchased this bike 3 days ago. I spent a week on my buddies Road King and felt like I had to have one. My budget unfortunately was under $8000. So I started looking for a 2007-2008 Kawasaki Nomad. I found my Road Star on Craigslist from a dealer 2 days before my appt. to test ride a Nomad. I didn't have high expectations on the bike as I was really sold on the Nomad, but thought why not look take a peek?

The Road Star was about $1500 dollars cheaper than the Nomad. My first impression of the bike's appearance was very good. The classic look of the engine with no radiator is this bike's best visual attribute. This bike has a stage 2 jet kit, and Cobra Speedsters pipes.

Being mostly a sport bike fan, I was not prepared for the sound that burst forth once the bike was started. Holy cow! I did not know a metric cruiser could sound so good. Very deep lope and rumble. Taking it for a test ride was amazed at how smooth it was. Even though the sound coming from the end of the pipes gave sense of vibration, at speed there's hardly any.

My bike has aftermarket saddle bags and a quick release windshield. I love it, and for sure made the right decision.

Twitter Announces New Policy On Copyright Complaints

Abstract: On Friday November 2, in a Tweet, Twitter announced a new policy regarding how it would handle tweets regarding which it received a copyright complaint.



Twitter has announced a new policy with respect to tweets about which it receives a copyright complaint under the DMCA. Upon receipt of a complaint, Twitter will now replace the tweet with a message reading "Tweet Withheld. This Tweet from @Username has been withheld in response to a report from the copyright holder." Tweets containing media will be dealt with similarly. Unsurprisingly, Twitter may also suspend or block repeat offenders. the complete new policy can be found on the "Copyright and DMCA Policy" page in Twitter's help Center.

As it already does with other requests to block or remove Tweets, Twitter will be sending these new DMCA reports to us here at Chilling Effects.

You may be wondering, as I was when I first heard about this, how it would be possible to infringe copyright in 140 characters. Surely such a small snippet of text is fair use? And isn't Twitter all about the retweet? The answer is that Twitter clearly does not expect literal infringement, via copying, by the text of tweets. Rather, infringement will take place through links or attached media. To wit:

"the unauthorized use of a copyrighted image as an profile photo, header photo, or background, allegations concerning the unauthorized use of a copyrighted image uploaded through our photo hosting service, or Tweets containing links to allegedly infringing materials."

As has been the case recently with announcements like this, many Internet users were initially confused, and saw the announcement as one of censorship on Twitter's part. See this Slashdot thread as one example.

Bleeding Edge Twitter users may also have been confused by this Tweet , which turned out to be a hoax perpetrated by a security researcher who had searched for a blocked tweet but had been unable to find one, so created his own. Others have already followed suit.

As always, it's worth noting that under the DMCA, a complainant does not need to prove to Twitter that copyright has been violated, or even that they hold a valid copyright in the material in question.
We'll have to wait and see in coming days if this new policy is used more to withhold legitimately infringing Tweets, or if it becomes primarily a tool for censorship.

Marvin Miller, union leader who changed baseball, dies at 95

Nothing about Marvin Miller seemed feisty or controversial at first glance; the soft-spoken economist was a smallish man with gray hair and a tidy mustache.

But as a union leader, it was Miller who took on baseball's establishment in the late 1960s, eventually guiding players to an era of mega-salaries and free agency, thereby changing the landscape of American sports.

"Nobody realized how gargantuan the task was," he said years later. "Major league players were, at the time, truly brainwashed."

Miller died Tuesday at his home in Manhattan, several months after being diagnosed with liver cancer, his family announced. He was 95.

Historian Studs Terkel characterized him as "the most effective union organizer since John L. Lewis," the legendary mine workers leader. Hank Aaron, one of the game's most-prolific home run hitters, wrote that he "should be in the Hall of Fame [even] if the players have to break down the doors to get him in."

During Miller's tenure as head of the Major League Baseball Players Assn. from 1966 to 1982, average salaries rose from $19,000 to $241,000, in large part because he fought baseball's antitrust exemption and gave players the right to move from team to team.

"Marvin possessed a combination of integrity, intelligence, eloquence, courage and grace that is simply unmatched in my experience," said Donald Fehr, who later headed the players union. "Without question, Marvin had more positive influence over Major League Baseball than any other person in the last half of the 20th century."

But not everyone appreciated Miller. As basketball and football subsequently adopted free agency, fans saw higher ticket prices, work stoppages and a new order in which favorite players often switched teams.

"You may not like what he did," said David Carter, executive director of USC's Sports Business Institute, "but you can't argue with how he did it."

Before Miller's arrival on the scene, owners dominated the sport. It came as a shock when Dodgers stars Sandy Koufax and Don Drysdale held out for more money in 1966, the team eventually signing them for $125,000 and $110,000, respectively.

That same spring, the ineffective players union went looking for a leader and was referred to Miller.

Born April 14, 1917, he had grown up in Brooklyn, and his fondest childhood memories included Dodgers games at Ebbets Field, a short subway ride from home.

Miller received an early education in trade unionism from his father, a garment district salesman who organized fellow workers. After graduating from New York University, he worked for the New York City welfare department before taking jobs as an economist with the War Production Board and the War Labor Board during World War II.

"It was kind of like a utopian dream," he said of the latter board, created to handle disputes between management and workers. "And it worked remarkably well."

Miller subsequently moved to the United Steelworkers, where he spent 16 years as a research economist and, later, assistant to the president. In 1963, President Kennedy appointed him to a national labor management panel.

After the players union approached him, Miller made the rounds at spring training, facing opposition from wary players.

"The club owners are saying that you're one bad guy; they're saying terrible things about you," he recalled hearing.

Miller told them: "If I represent you and, at some point down the road, you begin to hear management people praising me, it's time to fire me."

Ultimately elected, Miller entered a domain that had yet to be influenced by multimillion-dollar contracts and billion-dollar television contracts. Players were paid relatively little and bound to their teams, moving from one to another only if traded.

Lines by Madonna and other celebs pop up in stores

This holiday season you're likely to spot singer Jennifer Lopez in Kohl's. You could get a peek at pop music icon Madonna in Macy's. You might even catch a glimpse of reality TV star Kim Kardashian in Sears.

Well, not literally.

These celebrities likely won't be making guest appearances in the aisles of your favorite department stores. But clothes, shoes and even ties that bear their names will.

It's part of a big push by stores to cash in on celebrities' money-making names. The move can be savvy. After all, who wouldn't want to don the stylish duds of a superstar? It can also be risky. The stars, figuratively, have to be aligned for celebrity lines to become a hit with shoppers. That can mean having the right celebrity pair up with the right store at the right time with the right amount of involvement in the design of the line.

"If it's simply to monetize your moment in the sun, it is not going to work in the long term," says Ivanka Trump, the daughter of real estate mogul Donald Trump who is an executive vice president for his Trump Organization and appeared on his "Apprentice" reality TV show.

Trump, 31, has a line of $150 handbags and $125 pumps at Lord & Taylor and other department stores. "You have to be involved in every aspect of the product line," she says.

Celebs have long dabbled in design. But with the growth of TV shows and websites that follow everything celebrities say, wear and do, interest in their clothing lines has risen in recent years. Indeed, North America revenue from celebrity clothing lines, excluding merchandise linked to athletes, rose 6 percent last year to $7.58 billion in 2011, according to the latest figures available by The Licensing Letter, an industry trade publication. That's on top of a nearly 5 percent increase in 2010.

Major department stores, facing growing competition from trendy fashion chains such as H&M, Mango and Zara, have jumped on the trend. They're hoping to reap benefits from the lines during the holiday shopping season in November through December, a time when stores can make up to 40 percent of their annual revenue. Big stores now get as much as a quarter of their sales from celebrity brands, up from under 10 percent five years ago, according to market research firm NPD Group.

As interest from stores and shoppers grows, so does the list of celebs with their own lines. Rocker Bon Jovi, 50, just inked a fragrance deal with Avon Inc. Madonna, 54, has a new Truth or Dare line of perfume, over-the-knee lace-up boots and other shoes at several department stores. Nicole Richie, 31, former reality TV star and daughter of singer and songwriter Lionel Richie, earlier this year rolled out an eponymous clothing line of $86.50 floral maxi skirts and $49.50 lace tops on QVC home shopping network.

And singer Jennifer Hudson's new fashion collection was launched on QVC this fall. Her line includes $96.50 hooded jackets, $53 blouses and one of her favorite wardrobe staples ?$50 leggings. Hudson, a spokeswoman for Weight Watchers weight-loss program, says her goal is to appeal to women of all sizes.

"Every piece is a part of me," says Hudson, 31, who recently slimmed down from a size 16 to a 6. "And it came from something that I have worn or would wear."

THE PIONEERS

Jaclyn Smith, who starred in the popular 1970s series "Charlie's Angels," pioneered the celebrity brand business in 1985 with a line of clothing and accessories at Kmart.

For more than a quarter of a century, the line that carries everything from $79 striped trench coats and $49 faux fur trimmed vests to $299.99 artificial Christmas trees and $179 dining sets, have become staples at the discounter. In fact, the products' success has risen even though Smith, 67, has long been out of the spotlight. Kmart officials declined to give sales figures, but retail consultant Burt Flickinger estimates the line rings about a $250 million in annual revenue, which is considered healthy.

"She's a beloved American icon," says Flickinger, adding that the line has remained popular because it's "timeless, in good taste and have quality."

Kathy Ireland, 49, a former Sportswear Illustrated swimsuit model, also turned her celebrity brand into a moneymaker. Since 1993, she has built a $2 billion global retail business, according to fashion trade publication Women's Wear Daily. Her line includes more than 15,000 items from curtains to wedding dresses that are sold in more than 50,000 small chains.

Ireland attributes her success to her methodical approach to expansion. In fact, her first foray into the business was socks. She wanted to see how something simple would sell before she rolled out swimwear, active wear and other items a year later in 1994.

"If women would embrace something as basics as a pair of socks, that would tell us we were on to something," says Ireland, who sketches looks for her line for a design team to refine.

More recently, singer Jessica Simpson, 32, has built her brand into a billion-dollar brand in the past seven years. She now sells more than 29 products from shoes, clothes and perfume to purses and luggage in department stores such as Macy's. For the winter holidays, items include $89 platform bright blue platform pumps and $128 strapless belted lace dresses.

Her formula for success has been having a relatable personality: Even as her singing career has wavered, branding experts say Simpson has been able to connect with her young fans because she's vocal about everyday issues like her struggles with weight gain.

Peggy Merck, the publicist for the brand, also says she's very involved in designs for the line, which reflect her casual but sexy style. Her collection, which ranges from size 2 to 16, features lots of cowboy boots, vintage jeans and wedge shoes. Simpson is "hands on," Merck says.

Simpson's business savvy has inspired other celebs. "I admire Jessica Simpson a lot because she has branded her line to become a huge success," wrote "Jersey Shore" reality TV show star Nicole "Snooki" Polizzi in an email to The Associated Press.

Polizzi last year started selling perfume and nail polish, among other items at HSN home shopping network and to beauty chain Perfumania. This fall, she expanded her collection to include jewelry. She also plans to add headphones and accessories next year.

"I bring in my ideas on what type of bottle shape I'd like, to different designs of animal print or clothing designs to my favorite smells from soaps, lotions (and) hair sprays," Polizzi wrote.

BEYOND THE NAME

But attaching a star's name to a tee shirt or earrings does not guarantee success. Generally, how well a line does will vary greatly, depending on the star's popularity and involvement in the design, the quality of the merchandise and marketing of the brand.

There are all sorts of ways the merchandise deals work. But in many scenarios, the idea of starting a collection comes from the celebrity, who shops the concept around to manufacturers and stores. How the deals are structured varies widely.

The lines can be a gamble for stores. For one, their success often is closely tied to one person whose popularity can fade quickly among finicky fans. And while shoppers may grab celebrity brands when the lines debut, they may not return if they don't like what they see after that.

"The celebrity name draws the fan base to the product but at the end of the day, the product has to stand on itself," says Michael Stone, president of The Beanstalk Group, a global brand licensing agency. "It has to be well priced and well designed."

Indeed, industry experts say for every celebrity brand that is a hit, five others flop. Anyone remember hip hop star and actor L.L. Cool J's casual clothing line with Sears? It lasted less than a year after its launch in 2008. One reason was that the collection of hooded sweatshirts and jeans failed to catch the eyes of Americans at a time when the country was in a deep recession.

It's also key that the clothes reflect the personality of the celebrity because many consumers will want to emulate their style. For example, Lopez, 43, shuttered her Sweetface clothing collection in 2009, six years after launching it at several department stores, in part because shoppers didn't believe that the line matched her glam style. The collection, which included sweat pants instead of the fitted dresses Lopez is known for sporting, were seen as too casual.

But Lopez learned from that line. Last year, she launched an exclusive collection for Kohl's, which offers $99.99 platform wedge boots and $60 animal print faux-wrap dresses under her name. The collection is faring well, according to Kohl's, although the chain declined to give sales figures.

"Every look in this collection ... is something that people know I would wear," reads a statement by Lopez on Kohl's website.

It's also important that a celebrity doesn't say or do things that could reflect poorly on a store's image. Earlier this month, an angry customer started an online campaign calling for Macy's to dump Donald Trump's line of $65 power ties and $65 dress shirts after the billionaire verbally attacked President Barack Obama on social media after he won re-election.

Angelo Carusone, 30, who has collected nearly 673,000 signatures on petition website signon.org. Carusone, once a loyal Macy's shopper, says he won't shop there again until the retailer severs ties with Trump. "Macy's is building a brand on Trump's consequence-free bullying," he says.

But Macy's has stood by the billionaire, and the uproar has since died down. "Macy's marketing and merchandise offerings are not representative of any political position," says Jim Sluzewski, a spokesman for the chain.

Odd pairings can also be a concern. Indeed, Sears, a struggling retailer that is best known for selling appliances, raised eyebrows when it announced that it would carry clothes under the "Kardashian" name. The collection, which was launched last year, is named after "Keeping Up With the Kardashians" realty TV stars Kim, Khloe and Kourtney Kardashian.

The fashions embrace the individual looks of the sisters ? Kim's glamorous style, Kourtney's Bohemian chic look and Khloe's rocker influence. There are $99 leopard print maxi dresses, $24 snakeskin print earrings and $40 metallic striped tops.

When thinking about Sears as a possible partner, Khloe says she at first thought of the retailer as a place just to buy "washers and dryers." But then, she says she and her sisters realized that Sears would enable them to achieve their goal of selling affordable clothes nationwide.

"We felt it was a good fit," she says. "It's like if you date a few people and then you want to marry that person."

Ron Boire, Sears' merchandising chief, declined to give sales figures, but says the line is doing well and gives the chain's clothing department a "younger, more progressive feel."

To celebrate the one-year anniversary of the collection, the Kardashian sisters showed up at a Sears store in the Bronx borough of New York City on a recent Friday. More than 2,000 shrieking teens and young women came to get a glimpse of them.

Among them was Jenessa Cavallo, 23, a legal assistant. Until the Kardashian line was launched, she had never shopped at Sears. Now, she says that she keeps going back, spending more than $500 on Kardashian designs, including a faux fox fur coat, leather jacket and nail polish.

"I feel like I'm Kim," Cavallo says.

Rice's star rises as congressional opposition dims

WASHINGTON (AP) ? With congressional opposition softening, U.N. Ambassador Susan Rice could find her name in contention as early as this week to succeed Hillary Rodham Clinton as secretary of state. It's a step that may signal greater U.S. willingness to intervene in world crises during President Barack Obama's second term.

As Obama nears a decision on who should be the country's next top diplomat, Rice has emerged as the clear front-runner on a short list of candidates that many believe has been narrowed to just her and Sen. John Kerry, despite lingering questions over her comments about the deadly Sept. 11 attack on a U.S. consulate in Libya.

According to congressional aides and administration officials, Rice will be making the rounds on Capitol Hill this week for closed door meetings with key lawmakers whose support she will need to be confirmed. Those appearances follow her first in-depth explanation of her Benghazi remarks that Republicans seized on as evidence of the administration's mishandling of the attack that took the lives of the U.S. ambassador to Libya and three other Americans.

A senior Senate aide said the administration was trying to measure the strength of the Republican opposition to a Rice nomination, sounding out the more moderate members of the Foreign Relations Committee such as Sen. Bob Corker, R-Tenn., who is in line to become the panel's top Republican next year, and Sen. Johnny Isakson, R-Ga.

Assessing the prospects for Rice before Obama makes any announcement would avoid the embarrassment of a protracted fight with the Senate early in the president's second term.

On talk shows the weekend following the attacks, Rice relied on talking points provided by the intelligence community that described the attack as a spontaneous assault growing out of a protest of an anti-Muslim film. GOP critics say her remarks downplayed evidence of an obvious terrorist attack just weeks before the Nov. 6 election.

Republicans called her nomination doomed, leading to a vigorous defense of her by Obama in his first post-election news conference. But since then, GOP lawmakers seemed to have softened their views. Sen. John McCain, R-Ariz., who said earlier this month that would he do everything in his power to scuttle a Rice nomination, said on Sunday that he was willing to hear her out before making a decision. McCain ally Lindsey Graham, R-S.C., has also eased his opposition and said he is usually deferential to presidential cabinet picks.

White House spokesman Jay Carney said Monday that the administration appreciated McCain's latest comments about Rice, but wouldn't say whether the president saw them as an opening to make the nomination. "Ambassador Rice has done an excellent job at the United Nations and is highly qualified for any number of positions," Carney said.

Several diplomats currently serving with Rice said that what she lacked in Clinton's star power, she could make up with a blunter approach that demands attention and has marked her tenure thus far at the United Nations.

Rice, who at 48 is relatively young, has played the role of "conscience of the administration" on human rights and detainee issues and would bring "a certain edge" to the secretary of state job, according one colleague who has dealt with Rice on multiple issues over the past three years.

She "will not be going into the job as a star," said Karl Inderfurth, a former U.S. ambassador and senior State Department official who worked closely with Rice in President Bill Clinton's administration when she worked as a staff aide to the National Security Council and then as assistant secretary of state for African affairs. "She will be a rising star, though."

"Hillary Clinton understood the politics of diplomacy: what the person across the table needs in order to sell something," said Inderfurth, now at the Center for Strategic and International Studies think tank in Washington. "Susan Rice's background is different. What she'll bring is her experience in multilateral engagement and the limitations thereof."

"But the most important thing she brings to the table is her relationship with the president," Inderfurth said.

Rice, like many other foreign policy experts of her generation, was shaped by the Clinton administration's inability to prevent the genocide of hundreds of thousands of ethnic Tutsis and moderate Hutus in Rwanda 1994. Years later, she told a journalist: "I swore to myself that if I ever faced such a crisis again, I would come down on the side of dramatic action, going down in flames if that was required."

That doesn't mean the U.S. will change its policy of only providing humanitarian support to Syrian rebels fighting to overthrow the regime anytime soon. But Rice's confirmation as the next secretary of state could alter the balance in an administration that has viewed humanitarian interventions with significant skepticism, given its rejection of the Bush administration's war in Iraq.

An early supporter of Obama's 2008 presidential campaign, Rice fell out with some of her Clinton administration-era NSC and State Department colleagues who urged her to support Hillary Clinton's competing candidacy, including her own mentor, Madeleine Albright, and some of her top aides.

With the Clinton-Obama primary battle in full gear in April 2008, tension between the two camps was on public display at a ceremony and reception to unveil Albright's official portrait in the State Department's ornate 8th floor Benjamin Franklin room, according to several people present. At those events, Rice firmly brushed aside appeals that she switch allegiance, those present said.

Obama's 2008 election brought with it the prospect that Rice, one of his campaign's top foreign policy advisers, might be in line for the Cabinet job she is known to covet. Instead, however, Obama went with the surprise choice of Clinton and gave Rice the U.N. portfolio, although he attempted to deflect her disappointment by restoring the job to a cabinet level position.

But her sights remained set on the top job, according to people who know her.

Since arriving in New York, Rice can point to a series of diplomatic achievements ? most notably the NATO-led air campaign that toppled Libyan leader Moammar Gadhafi and tougher sanctions against Iran and North Korea over their nuclear programs.

But Rice has also been criticized ? along with other Security Council leaders ? for the failure of the U.N.'s most powerful body to take action to end the 19-month civil war in Syria.

She has also been criticized, especially by human rights groups, for being too protective of U.S. allies, namely Sri Lanka where the U.N. says up to 40,000 ethnic Tamil civilians may have been killed in the final months of the country's civil war that ended in May 2009, and Rwanda, which has been accused of backing the M23 rebel group that last week took control of the eastern Congo city of Goma.

As U.N. ambassador, she has gained a reputation for a sharp intellect and sharp elbows. She is not known for diplomatic finesse, rather for being aggressive ? sometimes too aggressive ? and using salty language on occasion. In private, she has a good sense of humor.

In a legendary exchange last December, Rice dismissed an appeal by Russia's U.N. Ambassador Vitaly Churkin, who also isn't afraid to speak out, for a Security Council investigation of civilian deaths in Libya from NATO's bombing campaign as "a cheap stunt" to distract attention from the Syrian conflict.

"Oh, the bombast and bogus claims," she told reporters.

Churkin responded by mocking Rice's Stanford University degree, saying: "We hear that the Obama administration wants to establish a dialogue with the international community in the United Nations... If this is the intention, really this Stanford dictionary of expletives must be replaced by something more Victorian."

Chicago proposes moratorium on school closings after 2013

CHICAGO (Reuters) - The Chicago public school district, which is expected to close dozens of schools next year, will impose a five-year moratorium on shuttering public schools after the fall of 2013, the new head of the district said on Monday.

The nation's third-largest school district, which weathered a nasty strike of public school teachers in September, is facing a financial crisis after granting pay rises to teachers in order to settle the strike.

It is widely expected to try to balance its budget by closing public schools because of falling enrollment. The school district said it has room for 500,000 students but has only about 400,000 enrolled.

Urban school districts around the country are grappling with the same issue of closing schools, including Philadelphia, Milwaukee, Kansas City, Detroit, Pittsburgh, and Washington, D.C., according to a study last year on school closings by the Pew Charitable Trust.

Feelings are still raw after the first Chicago teachers strike in 25 years drew national attention to the city's dispute over education reform. Chicago teachers and some parents complain that the school district has ignored their concerns.

The offer of a five-year moratorium was seen as an attempt by Chicago Mayor Rahm Emanuel, who has championed education reform and has repeatedly clashed with the teachers union, to provide some stability to Chicago schools after closings in the coming year.

"Mayor Emanuel recognizes that for many years CPS (Chicago Public Schools) has made too many piecemeal decisions around school actions, which has caused unnecessary disruptions to students, parents and schools across the city," said Barbara Byrd-Bennett, who was appointed by Emanuel after the strike ended to head the district. Byrd-Bennett spoke to a business group on Monday at the City Club of Chicago.

The district faces a December 1 deadline to issue a proposed list of schools to be closed, although Byrd-Bennett has asked the Illinois legislature for a four-month delay until March 31.

The union has previously said it wants an immediate halt to school closings, and the Chicago Teachers Union was expected to react to the moratorium proposal later on Monday.

The Chicago Tribune has reported that school district officials are considering closing up to 120 schools next year, or about 17 percent of schools. The district has established a commission to study the issue.

Enrollment in Chicago Public Schools has fallen nearly 20 percent in the last decade, mainly because of population declines in poor neighborhoods.

Some 140 schools are half-empty, according to the district. The union said 86 Chicago public schools have closed in the past decade, but the district could not confirm that number.

At the heart of the dispute over school closings is the expansion of charter schools, which are publicly funded but mostly nonunionized. The number of charter schools has risen even as neighborhood public schools are closed.

The teachers union has complained that charter schools undermine public education and force more community schools to close. Their academic performance record compared with community schools is mixed, according to national studies.

Chicago now has 103 charter or "contract" schools, some run by philanthropists, which account for 12 percent of students. There are plans by supporters for 60 more charter schools over the next five years, according to the district and the union.
